Fairly strong gusty winds of about 40kmph can be expected over Northern, North-Central, Central and North-Western provinces and in Trincomalee and Hambantota districts.

The sea areas off the coast extending from Mannar to Colombo via Puttalam and sea areas off the coast extending from Matara to Pottuvil via Hambantota will be rough at times. Other sea areas around the island will be moderate to fairly rough.

General public is kindly requested to take adequate precautions to minimize damages caused by temporary localized strong winds and lightning during thundershowers.

Navigating amidst challenges, BoC strengthens its industry leadership position

The Bank has reported Rs. 32.0 billion Profit After Tax (PAT) for the year ended 31 December 2022 despite of many headwinds caused by the never experienced economic and operational environment prevailed during the year.

Fund Based Income

Despite of never experienced economic and operating environmental challenges prevailed, the net interest income grew by 13.6% to Rs. 126.3 billion contributing 71% to total operating income. The increase in interest rates in line with the upsurge in policy rates and materializing the volume growth resulted 61% growth in interest from loans and advances which denotes 68% of total interest income. Interest income from investments boomed up YoY to Rs. 146.0 billion and the major portion of it derived through Treasury Bills and Bonds.

The upsurge in deposit rates increased the cost of funding, YoY interest expense hiked by 121% and as considerable portion of FDs are reprised by now, during the latter part of this year interest expense moved up by nearly threefold than previous year.

Non- Fund Based Income

As rupee depreciation is around 81% for the period, net exchange gains derived through trading activities and currency conversion represents considerable portion in non-fund based income amounting to Rs. 32.9 billion. Similarly, net fee and commission income also contributed Rs. 16.4 billion with 15% growth as business operations are now normalized and increased number of retail transactions and trade financing activities caused in improvement in related fee income.

As conducive environment was not prevailed in the Share market activities during the year the mark to market losses of Rs. 804.4 million was resulted from equity and unit trust portfolio. However, through trading of equity and Government security the Bank was able to gain Rs. 861.3 million.

Impairment Charges for Loans and Advances and Other Financial Instruments

From January 2022 onwards, impairment provision for loans and advances and investment were provided in compliance with CBSL Directions No.13 and 14 of 2021 on Classification, Recognition and Measurement of Credit Facilities and Financial Assets. Thus, the impairment provision for loans and advances and financial investments were calculated to capture the expected losses associated with the customers or the investment instruments based on the possible consequences in current economic conditions, sector specific risk factors, new policy reforms, present negotiations in foreign and local debt settlements by the Government.

Management overlays were applied to identify the risk elevated industries which results the significant increase in credit risk due to spillover of economic turmoil prevailing the country and exposures to those industries were assessed as underperforming to account for life time credit loss on prudent basis. Further, the Economic Factor Adjustment (EFA) which is used in calculating the expected losses for collectively assessed portfolios were enhanced by capturing the stressed economic condition prevailed at present. Nevertheless, the Individually Significant Customers (ISL customers) were also assessed critically given the high degree of uncertainty and extraordinary circumstances in the short-term and mid-term economic conditions mainly caused by the continuous disruptions to businesses and prudent level of ISL impairment provision were made. Rainy conditions in most parts of the island today

Rainy condition is expected to enhance to some extent over the island today.

Showers will occur at times in Eastern, Uva and North-Central provinces and in Mullaitivu and Matale districts. Fairly heavy showers above 75mm can be expected at some places in the Eastern and Uva provinces.

Showers or thundershowers will occur at several places in Western and Sabaragamuwa provinces and in Kandy, Nuwara-Eliya, Galle and Matara districts during the afternoon or night. Fairly heavy showers above 50mm can be expected at some places in the above areas.

Several spells of showers may occur in the Northern Province.

Fairly strong gusty winds can be expected over Northern, North-Central, Central and North-Western provinces and in Trincomalee and Hambantota districts. Winds will be north-easterly and wind speed will be (30-40) kmph and may increase up to (50-55) kmph at times.

Sea areas off the coast extending from Mannar to Colombo via Puttalam and sea areas off the coast extending from Matara to Pottuvil via Hambantota will be rough at times. Other sea areas around the island will be fairly rough.

General public is kindly requested to take adequate precautions to minimize damages caused by temporary localized strong winds and lightning during thundershowers.

Church of South India (CSI) was the first United Church in the world, organised between the episcopal (Anglican) and non-episcopal (Congregational, Presbyterian, Methodist) churches, inaugurated on the 27th September, 1947 at St George’s Cathedral Church in Chennai. The South India United Church (SIUC: Congregational and Presbyterian) came into being in 1908, and the Congregational Church of Ceylon (of the American Ceylon Mission) joined this Church Union in the year 1909. The year 1947, an year of transition for the Church in Jaffna in terms of Church Governance was from Congregationalism to Episcopal system, in which Rev Sabapathy Kulandran BA, BD was consecrated as the first Bishop of the Jaffna Diocese of the CSI. He retired on his 70th birthday in September, 1970. A few months after, Rev David Jeyaratnam Ambalavanar BD, MTh, was consecrated as Bishop at the Cathedral Church, Vaddukoddai on the 30Th June, 1971 in a solemn service, and installed as the second Bishop of the JDCSI. He served in that capacity until his 65Th birthday on the 28Th February 1993.

The ministry of his episcopate and leadership for twenty-two years marked him as an outstanding leader of his Church and Tamil Community in Sri Lanka. He was also an ecumenist with a fresh understanding of ecumenism deviating from the missionary era practice, ie: each denomination was confined to certain geographical region where its congregations existed and its ministry exercised. Churches of the ACM since 1816 were confined among the Tamils of the Jaffna peninsula. It was in the year 1979, he decided to take his diocese beyond Elephant Pass, as he was moved by the influx of Tamil refugees from the South and the Central Hill country into the Vanni region due to ethnic riots in 1977.

The displaced Tamil families sought refuge in the new region as a community of homeless and landless labourers trying to find a living under such conditions. The displacement of Tamils continued from the rest of the country, and escalated due to 1983 ethnic riots. It was in this context and subsequent armed conflict, the Jaffna Diocese under his leadership extended its services and pastoral care with pioneer church

workers both ordained and lay. The church established Day Care Centres (DCC) to feed, educate and protect children of preschool age, and over time Kinder Not Hilfer (KNH), Christian Children Fund of Canada (CCFC), with local and church resources supported this program both in the Vanni and in the Jaffna peninsula, and later it was extended to the Eastern Province since 1989 and to the Central Hills. Many other programs were added to support the families, women and men, as the affected and traumatised people in numbers increased due to war in the whole of North and East. Hence the Church’s mission spread far and wide with new congregations and communities established for the wellbeing of families with programs of new Housing and land for home garden, self-employment opportunities with new Vocational Training Centres (VTC).

The extension of the Church’s mission required more workers to serve in the new communities. The training for pastoral ministry and theological education in India for the candidates from Ceylon faced the challenge of obtaining Indian Visa for the 4-5 year courses of study. This led to a vision to establish the Christian Theological Seminary (CTS) at Maruthanarmadam, Chunnakam in October, 1983, and 95% of the clergy ministering now have been trained, along with a parallel program of Lay training. This year in October, the CTS marks 40 years of theological education and training for pastoral ministry during the war and post-war years.

The Newly Consecrated Bishop-

As the Church recalls the contribution of the late bishop, Rt Rev Dr D J Ambalavanar at his 95th birthday remembrance this week, the Protestant Christian Community both in Sri Lanka and in the Diaspora are relieved to know that the Rev Velupillai Pathmathayalan MA. BD, MTh was elected out of the two nominated candidates, later appointed, consecrated and installed on the 10Th of December 2022 at the Platinum Jubilee Chapel at the CSI Synod Secretariat in Chennai to lead the ‘bruised JDCSI’ to resurrect the 200 year heritage Church from the ashes. The welcome accorded to him at a special Service of Thanksgiving at the Vaddukoddai Cathedral Church in January 2023 was a testament to the high expectation of the Church and community at large for a new beginning. He and his episcopal ministry is held in high esteem with earnest prayers of the people of the Church and its institutions.

The appointment and installation of Miss Rosana Mathuramathy Kulandran BSc (Hons.), MA, MSc., as the tenth Principal of UGC on the 4th January this year has been warmly welcomed by the alumni across the globe and the local community. She is the grand-daughter of the late Bishop Sabapathy Kulandran, and a precious daughter to his son and daughter-in-law, Thayanithy Kulandran. The College comes under the purview of the JDCSI, and has been receiving financial support from the Jaffna College Trust Fund (JCTF) in Boston.

Jaffna College, Vaddukoddai-

The appointment and installation of Mrs Rushira Kulasingham BA (Jaffna), MA (Kelaniya), CTHE (Colombo), SEDA (UK), was held on the 6th of November, 2022 as the 9Th National Principal of Jaffna College. She is the grand-daughter of the late Mr I P and Mrs Rose Thurairatnam of Tellippalai, and a precious daughter of Mr Charlie and Mrs Saku Kunanayagam of Colombo. The independent Christian Private School is celebrating 200 years of the founding of the famous Batticotta Seminary, and 150th anniversary of Jaffna College this year. The College is managed by a Board of Directors, and has been receiving financial support from the JCTF in Boston and from the Alumni as well.

The Expectation-

The expectation of the Protestant Christian Community in Sri Lanka and in the diaspora is to see a close cooperation between the JDCSI and CACM in the work of the Church’s mission though the JDCSI suffered enormous problems as stated above in the letter to the CSI Moderator in 2021. Among the many issues at hand, the Clergy Stipend of both churches, the upgrading of the JDCSI Clergy in both theological education and ministerial formation, the recovery of Church lands for the mission of the Churches, avoiding duplication in certain outreach programs, and the urgent need for fresh understanding and cordial relationship between the two Churches are of paramount importance for the elected officers, clergy men and women and believing community. We commend this vision for all involved, including the mission partners local and overseas.

Israel and Palestinians pledge to reduce violence

BBC reported that the Israeli government and the Palestinian Authority have announced a joint commitment to take immediate steps to end a surge in violence.

The move has emerged from rare talks in Jordan, also attended by US and Egyptian officials. The meeting agreed to support confidence-building steps and “to work towards a just and lasting peace”.

As the talks took place, a Palestinian gunman shot dead two Israelis in the occupied West Bank. The Israeli military said it was pursuing the gunman and reinforcing troop numbers in the West Bank, deploying two additional battalions. It confirmed that one of those killed in the village of Hawara, near Nablus, was a soldier. Israel’s government described the killings in Hawara as “a Palestinian terror attack”.

Hours after Sunday’s shooting, a large group of settlers entered the same village and began throwing stones and setting trees and cars alight. At least 15 houses and a number of cars have been burned, according to Palestinian sources. Several families had to be evacuated from their homes. The Palestinian Red Crescent emergency service said hundreds were injured.

Nigeria election 2023: Votes are counted but final results may take days

BBC reported that vote counting is under way in Nigeria’s tightest presidential election since military rule ended in 1999.

Turnout appeared to be high, with many young, first-time voters arriving before dawn to cast their ballots.

Saturday’s voting was marred by long delays at polling stations, as well as scattered reports of ballot box snatching and attacks by armed men. And some parties have raised alarm over allegations of irregularities, which could lead to a disputed outcome.

The elections are the biggest democratic exercise in Africa, with 87 million people eligible to vote.

Politics has been dominated by two parties – the ruling APC and the PDP – since the restoration of multi-party democracy 24 years ago. But this time, there is also a strong challenge from a third-party candidate in the race to succeed President Muhammadu Buhari – from the Labour Party’s Peter Obi, who is backed by many young people.

Tens of thousands of polling stations are counting the results, which will be collated and sent to the electoral headquarters in the capital Abuja.

The final result is not expected until at least Tuesday.

Duplantis breaks world pole vault record with 6.22m in Clermont-Ferrand

Mondo Duplantis cleared 6.22m to add one centimetre to his own world pole vault record at the All Star Perche, a World Athletics Indoor Tour Silver meeting, in Clermont-Ferrand on Saturday (25).

The 23-year-old Olympic and world champion attempted the record height on his season opener in Uppsala at the start of this month, eventually winning with 6.10m for his best-ever season debut. He also tried 6.22m eight days later in Berlin, where he managed a best of 6.06m. This time, the Swedish pole vault superstar achieved the historic mark on his third attempt, soaring clear at 6.22m for the sixth world record of his career.

Duplantis entered the competition at 5.71m and cleared that height on his first attempt. He then passed at 5.81m and managed 5.91m on his second try. He had the competition won when he cleared 6.01m on his first attempt.

Then it was time to try 6.22m. He knocked the bar on his first and second attempts but the third was sublime.

Australia’s Commonwealth Games champion Kurtis Marschall finished second in Clermont-Ferrand, clearing an outright PB of 5.91m, and Menno Vloon of the Netherlands finished third, also with 5.91m. Czech Republic’s Amalie Svabikova won the women’s competition, clearing 4.66m.

Duplantis has now achieved a total of 60 six metre-plus clearances in his career so far.

All parties must ensure accountability towards the country – NMSJ

The National Movement for Social Justice (NMSJ) says it is very important for every responsible party, including every citizen, to have a proper understanding of the true nature of the serious crisis that the country is facing today.

Chairman of NMSJ, Karu Jayasuriya, in a media statement, said there cannot be any debate among many of them as to who is really responsible for the crisis the country is facing today.

He pointed out that, however, at this moment, no one can avoid raising the question as to whether all parties are working with a real understanding of the great danger the country is facing.

“We raise this issue with a sincere feeling about the entire nation, without any power aspiration or patronage of any political camp, and because we have a responsibility to inherit a progressive country for the future generations without being trapped by race, caste, religion or other narrow limits,” he said.

The former Speaker added that today the country is not in a situation where we can divide and fight with each other for power, but in a situation where the country needs to be built by putting collective responsibility in front.

“It is very important that the Government, all other political parties, and institutions, that have to deal with national responsibility, and all citizens, in general, understand the need of the hour,” he emphasized.

“Therefore, we appeal to all parties, at this moment, to stop all activities that may hinder the well-being of the country, at least for a certain period of time. We believe that it is important for the Government to listen to the people’s sentiments and understand the issues well and resolve the issues, through the Parliament,” he said.The NMSJ also pointed out the need to hold elections in a timely manner while respecting the people’s opinion.

FSP calls for impeachment of President

Educational Secretary of the Frontline Socialist Party (FSP) Pubudu Jagoda has called upon Parliament to bring an impeachment motion against President Ranil Wickremesinghe.

Addressing a press conference in Colombo, Jagoda said that the President had made a statement in Parliament that there was no election to be postponed. “As per his latest statement, the Elections Commission’s announcement of its decision to hold elections on March 9, 2023 were not legal. If so, why did the UNP candidates contesting under his leadership make deposits and submit nominations. The next question is whether he was not aware of his party’s General Secretary signing those nomination papers. There is something seriously wrong here.” He said his party had serious doubts about the President’s sanity.

The only constitutional remedy available was to move a motion of impeachment against the President. Jagoda said.

President’s speech on LG elections 85% false – Polls monitors

At least 85 percent of the speech President Ranil Wickremesinghe made in Parliament on the local council elections, on Thursday, was misleading and it was an attempt to influence the courts, Sri Lankan election monitors said yesterday.

D. M. Dissanayake, Head of Operation at the Centre for Monitoring Election Violence (CMEV) said the Elections Commission had taken steps to hold elections on 09 March, as per the Local Authorities Elections Ordinance (Chapter 262). By stating that the Commission had not acted properly, the President had shown his ignorance, Dissanayake added.

On Thursday, addressing the Parliament, President Wickremesinghe said the Election Commission had not taken an official decision on a date to hold the local council polls.

“According to the provisions of the Local Authorities Elections Ordinance, it is the returning officers, of each district, that announce the election. They do so after accepting nominations. This time as well, the returning officers announced that the elections will be held on 09 March by issuing gazettes. It is obvious that the President has gone before Parliament and made a lot of false statements. This is a serious matter,” he said.

Dissanayake said that while the President had sought to mislead the people and there was nothing anyone can do because he had legal immunity. “He made this speech in parliament. So, automatically, he is protected by parliamentary privileges. Moreover, after the 19th Amendment, we can only file fundamental rights cases against the President. He is shielded despite the serious nature of his speech,” he said.

The President mentioned that on 14 December, 2022, he had summoned the Election Commission and informed them that this election can’t be held due to the economic situation of the country. Wickremesinghe added that he had met the EC again with the Attorney General on 05 January, 2023.

Executive Director of the Institute of Democratic Reforms and Electoral Studies (IRES), Manjula Gajanayake, said that both these meetings had been called by the President to intimidate the members of the Elections Commission.

“The President also brings in the AG for one of these meetings and he really tried to see whether the commissioners were divided. They were not friendly chitchats. The responsibility of the Elections Commission is to hold elections and it is also the responsibility of the President to do, according to our Constitution,” he said.

The President also mentioned that the Elections Commission should have asked Parliament for money to hold elections as finances is the responsibility of the Parliament. However, there is no mechanism or precedence for the Commission to approach Parliament, Gajanayake said.

“The Constitution says the President must facilitate elections, but during the past few months, Wickremesinghe had done everything in his power to obstruct elections,” he said.

Sumanthiran asks why CB not publishing annual reports on timely basis

Tamil National Alliance (TNA) MP M.A. Sumanthiran presented a private member’s Bill to the Bills Office to amend the Employee Provident Fund Act No. 15 of 1958 (as amended) this week.

He said that his Bill comes at a time when the country needs to seriously undertake economic reform. Part of that economic reform is the independence of the CBSL but also accountability of CBSL, he said.

Given below is the TNA MP’s statement on his Bill:

“The EPF is Sri Lanka’s largest fund, and all private sector (formal) workers are mandated to keep their retirement funds in the EPF. The EPF fund is managed by the Central Bank of Sri Lanka. As of 2019, there are 19.4 million accounts with the EPF, almost as many as the entire population of this country. Currently, even after an 80% depreciation of the Sri Lankan rupee, the EPF should be holding close to USD 10 billion in retirement savings of the hardworking Sri Lankan people. That is around 3.5 trillion rupees, in my estimate.

“More than the entire expected revenue of the government, for 2023. I don’t have precise figures, and must resort to estimates, because the EPF has been extremely irresponsible in publishing even its annual reports. Until November, the latest annual report available was for 2016. After we brought up this issue, during the Budget debates, they suddenly published the annual reports up to 2019. Why is the Central Bank not capable of publishing the annual reports, on a timely basis?

“Does this institution have the kind of management and accountability that people can trust? The Bond Scam from 2015 where the company Perpetual Treasuries, connected to the then Central Bank governor, bought a series of bonds, at low prices, allegedly using insider information, and then allegedly dumped these bonds on the EPF. As a result of the bond scam, forensic audits were ordered and the published forensic audits, in 2019, revealed that the EPF is exploited for private profit and manipulation of the bond market and share market to the detriment of Sri Lankan workers.

“The EPF Act, in its current form, requires that under section 5 (1) (h) the Monetary Board must provide, each year, information on each investment that it has made. This is to be done yearly and shared with the Minister, through the annual report. Not only has the EPF management (the Central Bank) failed to do that, it has refused to comply with RTI requests, even after the RTI Commission has had held that it should disclose information.

This Act is to increase the frequency of disclosure and add more clarity to the disclosures that will be required from the EPF, since it is presently not complying with the existing laws. Therefore, the amendment seeks to give clear requirements for (a) timely and regular disclosure; and (b) ensuring that the content disclosed provides sufficient information on the EPF to ensure accountability of the fund and safeguard the savings of workers. This amendment seeks to mandate better disclosure of information through the annual report (Section 5(1)(i)) and information on each purchase and sale of bonds/assets by the EPF (Section 5 (1)(h)) from an accountability perspective.”

Severe dollar crisis hobbles Bangladesh businesses

Aljazeera reports that there is a severe shortage of greenbacks in Bangladesh due to its dwindling foreign reserves and a sharp drop in the value of its taka currency against the dollar. In the past six months, Bangladesh’s foreign reserves have dropped below $32bn from $39bn while the value of the taka has fallen by 27 percent from 84 to the dollar to 107.

The South Asian nation has been facing severe economic hardship since Russia’s invasion of Ukraine a year ago. In its import-dependent economy, rising global fuel oil and other commodity prices have caused nearly double-digit inflation and depleted foreign reserves.

To protect the declining reserves, the government had stopped all non-essential imports and reduced the supply of dollars to commercial banks. This has not only forced banks to refuse new letters of credit applications but also has made their promised payments to foreign suppliers for previous imports uncertain.

Local media reported that at least 20 banks with negative balances in their foreign currency holdings could not make these payments.

Florida TV journalist and girl killed near homicide scene

BBC reported that a TV reporter and a nine-year-old girl have been fatally shot outside Orlando, Florida, near the scene of a murder that took place hours earlier.

A second reporter and the girl’s mother were also shot and injured by the same gunman, who police say is suspected of the homicide earlier on Wednesday.

The two Spectrum News 13 journalists were covering the killing of a woman in the area that morning when the suspect returned, police say.

It is unclear if they were targeted. The suspect was armed when he was arrested and was not co-operating with police, said investigators.

None of the three people killed in Wednesday’s two attacks in Pine Hills, a suburb west of Orlando, have yet been identified.

In a news conference, Orange County Sheriff John Mina said the film crew were “in or near their vehicle”, which he said did not look like a TV station’s official vehicle, when they were attacked at around 16:00 local time (22:00 GMT). He said the journalists had been reporting on a shooting that took place earlier in the day at around 11:00 local time, which saw a woman in her 20s fatally shot inside a car, when the suspect returned to the crime scene and opened fire.

After attacking the journalists, the alleged gunman – Keith Moses, 19 – went into a nearby home and shot the girl and her mother, the sheriff said. The mother was in hospital in a critical condition, he added.

Other nearby journalists helped provide first aid to the victims, according to local reporters.

Well of hypocrisy

One’s gorge rises at the sight of cheap theatrics in Parliament, which has become a metaphor for hypocrisy. On Tuesday, the SJB MPs invaded the Well of the House, carrying placards and shouting slogans in protest against the government’s efforts to delay the local government elections. The dissident SLPP MPs cheered them on from the sidelines. The protesting MPs’ consternation is understandable, and their show must have gladdened the hearts of all those who treasure franchise and cleave to democratic norms and values. But are these MPs genuinely concerned about the people’s rights? The answer is an emphatic no; their hypocrisy stinks to high heaven. Before putting on Tuesday’s show, they should have tendered an apology to the public for having aided and abetted a conspiracy to postpone elections a few years ago. Most of the SJB MPs who have taken up the cudgels for the people’s right to vote were in the UNP-led Yahapalana government, which introduced the Provincial Council Elections (Amendment) Act in 2017 to postpone the PC polls indefinitely with the help of the SLFP, the JVP, the TNA and the SLMC. They knew that the amendment Bill had been stuffed with a slew of sections, at the committee stage, but that did not deter them from voting for it.

The Rajapaksas and their hangers-on in the Joint Opposition, in 2017, let out howls of protests when the PC polls were put off, and endeared themselves to the public. Today, they have thrown their weight behind President Ranil Wickremesinghe, who is doing his damnedest to postpone the mini polls because both the SLPP and the UNP are aware that an election at this juncture is bound to be their undoing. Former President Mahinda Rajapaksa plays dumb when reporters question him on the government’s plan to delay the LG polls, and cuts a pathetic figure in the process. There is no way he can absolve himself of the blame for this sorry state of affairs. SLPP General Secretary Sagara Kariyawasam’s criticism of President Wickremesinghe’s determined bid to put off elections reminds us of a ruse employed by pickpockets, who get their accomplices to catch, beat and take them away, when they fail to make good their escape so that the real pursuers will not be able to lay a hand on them.

The SLPP dissidents make themselves out to be an order of knights on mission to protect the people’s franchise, but they unflinchingly went along with the Rajapaksa government on its decision to postpone the local council polls last year.

The subjugation of the electoral process to the political agenda of the President is symptomatic of a crippling malady that Sri Lankan democracy is stricken with. The executive presidency has, like a cancer, eaten into the vitals of all other key state institutions including the legislature, and debilitated them. The 21st Amendment was hailed as a progressive law that would help strengthen the independent commissions and depoliticise the state service. But the Election Commission is groaning under the President’s boots. The Government Printer has become a handmaid of the President, who also has the Secretary to the Finance Ministry on a string. The National Police Commission has become a big joke and the IGP a lackey of the Executive. The police act as the President’s Brownshirts. The less said about the Attorney General’s Department, the better. The state prosecutor is facilitating the persecution of the political enemies of the government in power by using the PTA (Prevention of Terrorism Act) against them.

At this rate, the Executive President will be able to do away with all elections with the help of the Secretary to the Finance Ministry and the Government Printer, and suppress people’s protests by deploying the police and the military.

The SLPP-UNP juggernaut bearing down on the people has to be stopped. Hence the need for an election. Whether a ray of hope will emanate from Hulftsdorp for the hapless public languishing in the depths of despair, or they will lose faith in the judicial process as well, and be left with no alternative but to take to the streets to vent their anger and seek justice remains to be seen.

Pakistan’s president by passes EC and declares poll date in provinces

Winds lash Madagascar’s coast as Cyclone Freddy makes landfall

At least one person has died after a tropical cyclone battered Madagascar’s east coast, with heavy rain and powerful winds tearing roofs off houses and triggering a storm surge.

Cyclone Freddy made landfall on Tuesday, weeks after another tropical storm killed 33 and left thousands without shelter. Schools have been shut and traffic has been suspended.

Earlier, Freddy caused some damage in Mauritius, flooding beach-side hotels.

The Indian Ocean island nation is particularly vulnerable to cyclones. It is hit by an average of 1.5 cyclones every year, the highest rate in Africa, according to the United Nations Office for the Co-ordination of Humanitarian Affairs.

The cyclone slightly weakened once it made landfall on Madagascar, situated off the south-east coast of Africa, with wind gusts exceeding 130km/h (81mph). The country’s meteorological service warned that torrential rains would continue along its path.

How govt. agenda caused erosion of public faith in some independent commissions

The Supreme Court (SC) on Feb. 10 dismissed a contempt of court application filed by the Human Rights Commission of Sri Lanka (HRCSL), delivering a shock therapy to the latter.

The HRCSL filed the contempt case against the Chairman of the Ceylon Electricity Board (CEB) N.S. Illangakoon, the Secretary to the Ministry of Power and Energy, M. P. D. U. K. Mapa Pathirana, and Chairman of the Ceylon Petroleum Corporation (CPC), Uvais Mohamed, for failing to comply with an agreement to provide uninterrupted electricity to students sitting for the 2023 Advanced Level (A/L) examinations.

The HRCSL consists of retired Supreme Court Justice Rohini Marasinghe, Venerable Kalupahana Piyarathana Thera, Dr. M.H. Nimal Karunasiri, Dr. Vijitha Nanayakkara and Ms. Anusuya Shanmuganathan.

Moving of SC was consequent to a controversial determination made by the HRCSL. On Jan. 30, 2023, the HRCSL determined the Secretary, Ministry of Power and Energy, Chairman, CEB, and the Managing Director/Chairman, Ceylon Petroleum Corporation, failed to provide electricity, without interruption, during the Advance Level examination, from Jan. 23 to Feb. 17, 2023. The HRCSL found fault with them for not adhering to an agreement worked out by the independent commission.

The HRCSL deemed the CEB Chairman guilty of the offence of contempt, under the provisions of the Human Rights Commission of Sri Lanka Act No. 21 of 1996. The CEB Chairman was accused of willfully and maliciously disregarding the agreement. The Commission called the CEB’s failure to provide an uninterrupted electricity supply, during the examination period, a gross violation of a child’s right to education.

The CEB refused to stop power cuts until the Public Utilities Commission of Sri Lanka (PUCSL) approved a new electricity tariff formula. The CEB announced an end to power cuts immediately after the PUCSL finalized a new electricity formula on Feb. 16.

Of the five-member PUCSL, three, namely Attorney Chaturika Wijesinghe, Douglas Nanayakkara and SG Senaratne, gave the go ahead for a 66 percent tariff increase. They defeated a proposal that had the backing of the PUCSL Chairman, Janaka Ratnayake, for a 36 percent increase. D.N. Kushan Jayasuriya is the other member of the PUCSL.

Having waged a high profile campaign, against the proposed second electricity price hike, Janaka Ratnayake finally suffered a major setback. Ratnayake has lost control of the PUCSL. President Ranil Wickremesinghe personally intervened in the matter and, after careful planning, brought in new members, in place of Mohan Samaranayake and Udeni Wickremesinghe, who served as the Deputy Chairman of the PUCSL at the time trouble erupted at the independent commission.

President Wickremesinghe effected the required changes in the PUCSL to facilitate cooperation between the PUCSL and the Power and Energy Ministry. Wickremesinghe has intervened in the PUCSL in a way no previous President interfered, as he sought to suppress dissent therein. The PUCSL, established by the Public Utilities Commission of Sri Lanka Act No. 35 of 2002, is the economic, technical and safety regulator of the electricity industry, as well as the designated regulator for petroleum and water supply industries. The PUCSL also functions as the shadow regulator for lubricants sold here.

The PUCSL undertakes regulatory responsibilities in terms of the Sri Lanka Electricity Act No. 20 of 2009.

A major contentious issue is the continuing failure, on the part of successive governments, to secure parliamentary approval for the relevant Acts to regulate the water services and petroleum industries.

The HRCSL should examine the quarrelsome issue, involving the CEB, Power and Energy Ministry, and the CPC, over power cuts imposed during Gotabaya Rajapaksa’s administration. The HRCSL cannot take its failure to convince the CPC and the CEB, and the Power and Energy Ministry, to provide uninterrupted power supply during the Advance Level examination, lightly.

Power and Energy Minister Kanchana Wijesekera has been strongly critical of both the PUCSL and the HRCSL. Wijesekera questioned the HRCSL’s intervention after the independent commission announced an unprecedented agreement with the CEB, the CPC and the Power and Energy Ministry.

The recent turmoil undermined both the PUCSL and the HRCSL. Those who are genuinely concerned about the effective operation of the PUCSL and the HRCSL should be seriously concerned about the recent developments.

The Parliament should also examine the inordinate delay in expanding the PUCSL to play the role as water and petroleum sector regulator, as originally envisaged. It would be pertinent to mention that Janaka Ratnayake received appointment as Chairman, PUCSL, for the support he rendered during Gotabaya Rajapaksa’s 2019 presidential election campaign. Ratnayake received the appointment on Feb. 08, 2021. over a year after the last presidential election.

The turmoil in the PUCSL and the HRCSL undermined both commissions and erode public confidence in them.

EC caught up in political agenda

The Wickremesinghe-Rajapaksa government has dealt a deadly blow to the Elections Commission (EC) after its Chairman, Nimal Punchihewa, stood his ground in the face of relentless pressure, exerted by President Ranil Wickremesinghe, to put off the Local Government polls, scheduled for March 09. Wickremesinghe went all out to derail the electoral process, in the wake of the EC’s refusal to bow down to pressure. The government appeared to have been quite surprised by the truly independent stand taken by the EC. Even after EC member, P.S.M. Charles, quit the body, amidst threats received by some of them, Punchihewa, and Director General of the EC, Saman Sri Ratnayake, sustained the effort. However, finally the exasperated Wickremesinghe, having exhausted behind the scene tactics, intervened, publicly, and issued instructions meant to put off the Local Government polls, indefinitely.

After Charles quit, Nimal G. Punchihewa (Chairman), S.B. Divaratne, M.M. Mohamed, and K.P.P. Pathirana, remained members of the EC.

Considering the sorry state of the economy, may be this is not the time to hold polls for local councils, which are often corruption-ridden, with as many as 8000 elected members, who are a severe burden, we can do without, especially at this juncture. The Wickremesinghe-Rajapaksa government, however, is pursuing an agenda that erodes independent commissions. Surely the Parliament of this country did not install a new President, whom they thought was a mellowed politician, to complete the term of his predecessor, to suffer his hollow imperial airs. We know what happened to the country because his late uncle, President JRJ, tinkered with the democracy, at every turn, and fixed every election, held under his tenure, including the infamous referendum, and, finally, the whole country literally went up in flames. Let us only hope that history is not repeating itself.

We are not saying this because we have any greater trust in comrades waiting eagerly to taste power, despite having behaved worse than cannibals in the past, that includes their involvement in the May 09, and, thereafter, unconscionable acts of violence. Recently, MP Mahindananda Aluthgamage, at a press conference, gave a detailed list of the obvious charges they have to answe. So we will refrain from adding to them. But imagine what would have happened to this country had they, and their erstwhile comrades, the FSP, successfully stormed the Parliament, as planned last year, after having tasted success at overrunning other vital state bodies, in the guise of peaceful protests. Remember how a mob lynched just one MP, and his police bodyguard, on May 09, in public, or how they systematically destroyed properties of so many government politicians in that one night alone, across the country.

We are grateful to President Ranil Wickremesinghe for standing up to the mob mentality of the JVP/FSP and gathering up the shaken security establishment behind him to resurrect what was left of the government. It is also quite possible all that was a mere show for our consumption with the ‘Great Satan’ working behind the scene, not so mysteriously, to help him, as happened in places like Libya, or Ukraine, after creating similar situations.

As for the Rajapaksas, they threw away, almost overnight, so much they achieved for this country, because of just one sibling, Basil, and Mahinda succumbing to petticoat government to elevate his progeny, especially the eldest, to positions of power, well ahead of his time, without allowing him to season through the system.

For all we care, an inner clique, among the comrade leadership, unknown to their rank and file, and, along with leading Eelamists, could be working for a US agenda, to ultimately plunge, not only this country, but especially India, into chaos.

The government launched the project to undermine the EC, late last year, with Prime Minister Dinesh Gunawardena, who is also the Minister in charge of Public Administration, Home Affairs, Provincial Councils, and Local Government. Summoning the EC twice to the PM’s Office, where it was advised to postpone the scheduled election. Subsequently, President Ranil Wickremesinghe, too, summoned the EC twice. On both occasions, Premier Gunawardena was also present. But, they couldn’t convince the EC to put off the election, that is legitimately due.

Regardless of pressure being exerted on members, the EC insisted that election can be held, though the government experienced difficulty in releasing the required funds.

The police owed an explanation, regarding the status of the investigation into alleged threats, directed at some members of the EC, and a despicable bid made by IGP C.D. Wickremeratne to create another issue, by submitting highly exaggerated expenditure, pertaining to the March 09 poll. Some ministers, too, made a desperate bid to discourage the EC, and the electorate, by repeatedly warning of the government’s inability to meet the poll expenditure.

Wajira Abeywardena, MP, the lone UNP National List MP in Parliament, conducted a campaign of his own to justify the postponement of the poll, whereas UNP Chairman Palitha Range Bandara too played his part.

At the behest of the government, Public Administration, Home Affairs, Provincial Councils and Local Government Ministry Secretary, Neil Bandara Hapuhinna, made an abortive bid to derail the electoral process by directing Divisional Secretaries not to accept deposits from candidates. An angry reaction from the EC compelled Hapuhinna to withdraw instructions, issued on January 09. Hapuhinna found himself in an extremely embarrassing situation after Premier Gunawardena contradicted his claim that January 09 instructions were based on a decision taken by the Cabinet-of-Ministers. Now the matter is before the Supreme Court.

Samagi Jana Balavegaya (SJB) candidate for the post of Mayor of Colombo, Mujibur Rahuman, has moved the Supreme Court against Hapuhinna.

Having failed to manipulate the EC, President Wickremesinghe finally directed the Secretary to the Treasury, Mahinda Siriwardana, and Government Printer, Gangani Liyanage, to stop the electoral process. JVP leader Anura Kumara Dissanayake is on record as having said that the Government Printer was ordered to stop printing until the EC made the payments. There had never been such a deliberate bid to sabotage an election, under any circumstances, since the UNP put off the General Election, scheduled for August 1983.

The then President JRJ held a referendum, on Dec. 22, 1982, to ask the electorate whether it accepted extending the life of Parliament by six more years. Thereby the next General Election was held in 1989.

In terms of Article 104 B (2) and 104 GG (1) of the Constitution it makes it clear that all state authorities are duty bound to cooperate with the Elections Commission and that refusing, or failing to do so, is a criminal offence, punishable with imprisonment. In terms of Article 33 (c) of the Constitution, the President, too, is empowered to ensure the creation of proper conditions for the conduct of free and fair elections, at the request of the Election Commission.

Prez’s strategy

President Wikremesinghe’s UNP is not in a position to contest the Local Government polls. Wickremesinghe’s strategy is geared to avoid election this year. With the UNP now reduced to just one National List MP in Parliament, even though for a long time in the past it was one of the two major parties, is simply unable to conduct a LG polls campaign in its current decimated state. In spite of securing the Presidency, the UNP remains vulnerable, and extremely weak, politically. The UNP has conveniently turned a blind eye to previously taken Supreme Court decisions, relevant to the current situation.

During the Yahapalana administration, on Dec. 15, 2017. the Supreme Court in SCFR 35/2016 clearly explained the pivotal importance of conducting timely elections for local authorities and the importance of the franchise. The SC stated: “Franchise is a fundamental right enjoyed by people. According to Article 3 of the Constitution ‘In the Republic of Sri Lanka sovereignty is in the people and is inalienable. Sovereignty includes the powers of the government, fundamental rights, and the franchise”. Franchise is a fundamental right recognized under Article 10 and 14(1) of the Constitution. The failure to hold elections on the due date or postponing is a violation of fundamental rights of the people. Under Article 4(d) of the Constitution the fundamental rights which are by Constitution declared and recognized shall be respected, secured and advanced by all organs of the Government and shall not be abridged, restricted or denied save in the manner and to the extent hereinafter provided. In the present case the legislature as well as the executive had violated this Article.

If the government gets away with this, the next presidential and parliamentary elections, too, can be postponed on the same claim that economic recovery can be undermined by releasing of funds for the conduct of other elections. The government has conveniently forgotten that the Wickremesinghe-Rajapaksa government has allocated as much as Rs 10 bn for the EC, in 2023.

The possibility of the incumbent government seeking to put off future elections is a serious threat to the fragile democracy. Depending on the success of the current agenda, such actions can set a dangerous precedent for a detested executive or legislature to block the allocation of resources for an election and prevent the people of Sri Lanka from choosing their representatives and leaders.

JVP leader Anura Kumara Dissanayake told this writer that former Speaker Karu Jayasuriya, who recently received the coveted ‘Sri Lankabhimanya’ title, should explain his stand on the government bid to postpone the election. Incumbent head of the National Movement for Social Justice (NMSJ) Jayasuriya owed an explanation as he couldn’t remain silent as President Wickremesinghe has definitely undermined the independent commissions. The JVPer pointed out that the 20th Amendment, enacted in Oct. 2020, largely negated the 19th Amendment, introduced in 2015. The 21st Amendment was brought in Oct. 2022 to restore the provisions of the 19th Amendment and now President Wickremesinghe resorted to a strategy that weakened the very basis of independent commissions.

Having repeatedly assured that he wanted to restore parliamentary superiority and strengthen the independent commissions, the UNP leader not only went back on his word but pursued a deliberate strategy meant to undermine the very system he vowed to protect, lawmaker Dissanayake said.

The JVPer pointed out several decisions by Wickremesinghe, in recent weeks, supposedly aimed at managing public funds, have had the effect of preventing the Elections Commission from conducting the elections. These include a demand by the Government Printer for the release of funds, prior to the printing of ballot papers, and the Secretary to the Treasury claiming that there were no funds available for the elections. This is despite a budget allocation of Rupees 10 Billion for the purpose of elections, the MP said.

The JVPer alleged that the conduct of the Secretary to the Treasury, the Government Printer, and other government officials, and institutions, over the last few weeks clearly demonstrated a concerted effort to bring the elections to a halt, thus undermining the franchise of the people and endangering the sovereignty of the people of Sri Lanka. Such attempts to prevent elections mandated by law represent an unprecedented attack on democracy and the rule of law and pose a grave threat to the electoral process in the future, the JVP leader said.

AKD vows to stop allocating funds for ex-presidents, questions Sagala’s role

Jathika Jana Balawegaya (JJB) lawmaker Anura Kumara Dissanayake has called for an end to the practice of spending taxpayers’ money to maintain former Presidents and their spouses.

Bankrupt Sri Lanka couldn’t afford to look after political families, MP Dissanayake told a gathering in Colombo on Sunday. Referring to the former first lady Hema Premadasa receiving full state patronage since the assassination of her husband Ranasinghe Premadasa on May Day 1993, the JVP leader asked why successive governments had paid for maintaining what he called the former first lady’s luxury style.

MP Dissanayake said that if the JJB formed a government, such waste would be stopped forthwith.

The JVPer questioned the funds allocated for former Presidents Chandrika Bandaranaike Kumaratunga, Mahinda Rajapaksa, Maithripala Sirisena, and Gotabaya Rajapaksa at a time a vast majority of people were struggling to make ends meet.

Alleging that the government was working overtime to indefinitely put off the Local Government polls, scheduled for March 09, MP Dissanayake said that the growing indications that the JJB would make significant gains at the forthcoming poll jolted the government, and the Opposition, as well. MP Dissanayake alleged that in addition to the SJB and the Opposition Leader’s group, the Maithripala Sirisena-Dayasiri Jayasekera camp were thoroughly disturbed by the public response, received by the JJB.

Colombo District lawmaker Dissanayake said that the so called VIPs and VIP groups hadn’t experienced such a threatening situation before. The JVP leader asked the gathering whether they could think of one justifiable reason for the bankrupt government to allocate funds for ex-Presidents and ex-Presidents now serving as members of Parliament. Dissanayake said that the allocation of over Rs 10 mn each for ex-presidents couldn’t be accepted, under any circumstances.

MP Dissanayake also questioned the significant allocations made for two of President Ranil Wickremesinghe’s closest associates and presidential advisors, Sagala Ratnayake and Akila Viraj Kariyawasam.

In spite of both of them being rejected by the people at the last general election, held in August 2020, they received special treatment, MP Dissanayake said, claiming that Ratnayake, one-time Law and Order Minister, received a Rs 150,000 as monthly salary, Rs 81,400 fuel allowance, Rs 50,000 transport allowance and Rs 7,500 telephone allowance. Akila Viraj Kariyawasam received Rs 100,000 monthly salary, Rs 66,825 fuel allowance and an expensive SUV.

MP Dissanayake said that those in the government, and the Opposition, threatened by the rapidly changing political environment, ganged up against the JJB for obvious reasons.

The JVP leader said that they had been greatly strengthened by the sizable number of ex-military personnel, including senior officers, throwing their weight behind the growing political movement. Referring to former Eastern Commander, Maj. Gen. K.P. Anura Jayasekera, declaring his support for the JJB, MP Dissanayake said that though the military generally was opposed to left political parties, there was a significant and unexpected shift in response to the post-Gotabaya developments.

In the wake of Maj. Gen. Jayasekera’s declaration of support to the JJB, Field Marshal Sarath Fonseka has alleged that the extremist group, led by Zahran Hashim, stepped up activity during Jayasekera’s tenure as the Easter Commander. Lawmaker Dissanayake dismissed what he called the Field Marshal’s childish attempt to tarnish the former Eastern Commander’s name. Jayasekera received appointment as the Eastern Commander, in Nov. 2018.

How could the public have faith in a system where a person who killed a political opponent, during an election campaign, and was found guilty by courts, received appointment as State Minister, MP Dissanayake asked. The JVPer said that those who exercised political power realized that their days were numbered.

Referring to the Colombo High Court ruling, given in June 2022, pertaining to Housing Minister Prasanna Ranatunga, who is also the Chief Government Whip, MP Dissanayake said that Ranatunga was sentenced to two years rigorous imprisonment, suspended for five years, after he was found guilty of one of the charges in a case filed for threatening a businessman.

The Colombo High Court also imposed a fine of Rs. 25 Million on the Minister and ordered him to pay Rs. 1 million as compensation. The Minister has appealed against the HC ruling but how could we ignore the original ruling, the JVPer asked.

The JVPer recalled how the Rajapaksas suppressed investigation into the alleged fake currency printing case, involving Dulanjali Premadasa and former first lady Shiranthi Rajapaksa’s Siriliya case.

Danger of diabetes

Sri Lankans in general are simply not fully aware of the dangers arising from ‘Insulin Resistance’, popularly known as diabetes. We hear odd references to diabetes causing kidney failure, heart attacks, and stroke (brain damage). But we hear less mention of gangrene, blindness, Alzheimer’s disease, Limb amputation, depression and so on. Added to this is the damage done to us due to uric acid which doctors now attribute to weight gain, diabetes, dementia and consciousness fog in their patients.

This amounts to a formidable list of complaints caused by the goodies we love: sugar, sweets and carbohydrate consumption.

Hospital authorities do not reveal how many patients die under their care every day. An approximation may be as many as 90 people die each day in total from carbohydrate consumption in Sri Lanka. That is about, approx. 32,000 Sri Lankans die each year just to keep the sugar industry, the baking industry, and the medical importers and distributors in business.

You may realise that we (sugar eaters) are all in the sugar trap. It is a slow descent, a slow conveyor belt taking us to insulin resistance with medical practitioners serving us at every stage of disability, attempting to reduce the effects of the poison (at a price). But the poison wins us over in the end.

See how children’s food is charged with sugar. It seems the only way to entice young people to eat is to lure them with sugar, honey, jam, chocolate and jaggery and so on.

And, there is little emphasis on exercise, keeping fit, gymnastics and so many children become unhealthy and even overweight with little outlet for their excess energy in exercising, gymnastics, walking etc. With the matter of feeding our children, perhaps we have the cart before the horse, children need to express hunger before we ply them with not fancy foods, but down to earth, healthy foods.

Sugar is addictive. Notice how a cup of sweet tea will initiate cravings for more sweet things to eat. Craving arises due to addiction. Then you see the trap sugar has made for us.

People’s ignorance is costing them their lives, but there is no-one on the merry-go-round of sugar addiction to warn them to jump off~!

We have to learn new ways of making simple foods attractive, without sugar and carbohydrates.

It is the poor Buddhists taking the brunt of this death toll, especially those at the bottom of the economic ladder. They ignore the warnings to avoid sweet things and to eat a wide range of simple foods.

SJB to sue EC if LG polls delayed

SJB’s Colombo Mayoral candidate Mujibur Rahuman says that he will institute legal action against the Election Commission (EC) if it fails to conduct the local government elections, as scheduled.

“I will demand one billion rupees as compensation from the EC if it does not hold the local government elections. I resigned from my parliamentary seat following the EC’s under

taking to hold the local government elections to contest for Colombo Municipal Council.All the candidates in the elections process have been wronged by the EC,” Rahuman told The Island.

Former SJB MP Rahuman said that the EC had issued various statements on the elections. “If the EC fails to conduct the elections on 09 March, I will go to courts seeking compensation,” he said.

Rahuman resigned from Parliament to contest for the Mayor of Colombo at the upcoming local government election.Former Minister A. H. M. Fowzie, who polled 48,701 votes from the SJBs Colombo District at 2020 parliamentary election, was sworn in as an MP.
